Trademark and Patent Attorney in India

Trademark, copyright and patent are three most confusing words. All these three words are generally registered with the Federal Government. When some other company uses the trademark, copyright and patent of other companies without permission, it will be called as infringement. It is very important for every owner that they protects their own work from getting used by some other person.


A trademark is something which protects the services or products that comes from a specific company. For an example trademark represent the corporate logo which is generally placed on the products to show that it comes from a particular company. Patent is something which protects inventions. The inventions must be novel, useful and non-obvious. Non-obvious in the sense that someone who understands the technical area of the invention and also finds that the invention is wholly new and completely innovative in nature. The most important difference is that patent is generally registered with the Patent and Trademark office while each state of India has different Trademark laws. The trademark and patent does not come into being until it is not registered and your registration is approved. When a company have an idea, invention, or product that needs to be reliably put under a patent, the process can be both long and complicated. And if  the company does not do the processes properly then it can proves to be a devastating one.


A patent or a trademark lawyer has many responsibilities on his shoulders. They not only file a patent or trademark for the companies on behalf of their products or inventions but also look for the things which has been not already used by some other companies. The patent or trademark attorney must have a strong communication, writing skills as well as must have proper knowledge in litigation process. Choosing the right attorney  for your organization to handle all the proceedings is very important. The lawyer must specializes in all the areas. If the other company find any loophole in your process and can easily steal your idea under your nose. A good patent or trademark lawyer must know all the rules and regulations and also understand the
laws of India for application filing and all the related issues regarding patent and trademark.
